Elevate Your Biz Inc. (“EYB”, “we”, “us”) is a digital agency based in Oshawa, Ontario, Canada. We help Instagram fitness creators build monetization systems through digital products, sales funnels, and marketing automation.

What Information We Collect

We only collect information you choose to give us or that is automatically generated when you visit our site.

Contact and inquiry forms: When you fill out a form on our website (such as a strategy call request or contact form), we collect your name and email address.

Lead magnets: If you opt in to receive a free resource, we collect your name and email address to deliver it to you. By providing your email, you are giving express consent for us to send you the requested resource and follow-up content related to the topic you expressed interest in. You can unsubscribe at any time.

Automatically collected data: When you visit our site, standard technical information may be collected automatically, such as your browser type, the pages you visit, and approximate location (country/region). This is used to understand how people use our site, not to identify you personally.

We do not intentionally collect sensitive personal information such as health data, medical history, or financial account numbers through our website.

How We Use Your Information

Withdrawing consent: You can withdraw consent at any time by unsubscribing from emails, contacting us at support@elevateyourbiz.ca, or replying STOP to any automated message.

Withdrawing consent may limit our ability to provide certain services or communications.

Third-Party Tools We Use

To operate our business and website, we use the following third-party services. Each has its own privacy policy.

When you interact with any of these tools, their own privacy terms apply. We use only sub-processors that maintain their own privacy policies and data protection practices.

Cookies and Tracking

Our website (elevateyourbiz.ca) is hosted on Vercel. Vercel may collect basic analytics and performance data (page views, visitor counts, load times) through its built-in analytics and speed insights features. We do not currently use Google Analytics, Meta Pixel, or other third-party tracking scripts.

If we add tracking tools in the future, this policy will be updated accordingly.

You can disable cookies in your browser settings, though some parts of the site may not work as intended if you do.

Your Rights

Under PIPEDA (Canada's federal privacy law), you have the right to:

• Access the personal information we hold about you
• Correct any information that is inaccurate or incomplete
• Delete your information (subject to any legal obligations we have to retain it). We will process deletion requests within 30 days.
• Unsubscribe from any marketing emails at any time using the unsubscribe link in any email we send, or by replying STOP to any automated message
• Withdraw consent for the collection, use, or disclosure of your information at any time
• File a complaint with the Office of the Privacy Commissioner of Canada if you believe your privacy rights have been violated

Data Retention

We keep your information only as long as necessary:

• Marketing contacts (email list): Until you unsubscribe, or for up to 24 months after your last engagement if relying on implied consent under CASL
• Client data: For the duration of the business relationship plus 7 years for tax and legal record-keeping purposes
• Website analytics: Aggregated, non-identifying data may be retained indefinitely

If you request deletion, we will remove your personal information from our active systems within 30 days. Some information may be retained in backups for up to an additional 30 days before permanent deletion.

Cross-Border Data

Our primary operations are in Canada. Some of the third-party tools we use (e.g., ManyChat, Zapier, ConvertKit, Vercel) may store data on servers located in the United States. By using our services, you acknowledge that your information may be transferred to and processed in jurisdictions outside of Canada, where privacy laws may differ.

Data Breach Notification

In the event of a data breach that creates a real risk of significant harm to you, we will:

• Notify the Office of the Privacy Commissioner of Canada as required by PIPEDA
• Notify affected individuals as soon as feasible
• Provide information about the nature of the breach and steps you can take to protect yourself

We maintain a record of all data breaches for a minimum of 2 years, as required by PIPEDA.

Children

Our website and services are not directed at children under 13. We do not knowingly collect information from anyone under 13. If we become aware that we have collected personal information from a child under 13, we will delete it promptly.

Canadian Privacy Law

We operate under the laws of Ontario, Canada, and comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada's Anti-Spam Legislation (CASL).

If you are a resident of Quebec, we also comply with Quebec's Act respecting the protection of personal information in the private sector (Law 25), which may provide you with additional rights including the right to data portability and the right to be forgotten.
